These Terms of Use govern your access to LifeAfterDivorce.me and your purchase or use of digital products and private educational intensives offered through Life After Divorce, operated by EleMental Health Counseling & Consulting Services (“Life After Divorce,” “we,” “us,” or “our”). By accessing the website, purchasing a product, submitting an application, or using our services, you agree to these Terms.
Eligibility
You must be at least 18 years old and legally able to enter into an agreement to use the website, purchase a product, or participate in an intensive. The website and offers are intended for personal use by adults.
Educational nature of the offers
The workbook, website content, emails, social-media content, and private intensives provide education, psychoeducation, guided reflection, practical tools, and coaching-style support. They are not psychotherapy, mental-health diagnosis or treatment, crisis care, medical care, legal advice, or financial advice. Purchasing or participating does not create a therapist-client, physician-patient, attorney-client, or fiduciary relationship.
Jessica’s LPC-S credential identifies her professional background and licensure. It does not convert these educational offers into psychotherapy or establish a therapist-client relationship. You are responsible for seeking an appropriately licensed professional when your situation requires individualized mental-health, medical, legal, financial, or safety assistance.
Orders and payment
Prices, included materials, delivery methods, availability, and any limitations will be shown on the applicable sales or checkout page. You agree to provide accurate billing and contact information and authorize the payment provider to charge the amount displayed at checkout. Taxes may be added where required. We may refuse, cancel, or limit an order when reasonably necessary to address suspected fraud, pricing errors, misuse, or legal requirements. If we cancel a paid order for reasons unrelated to your violation of these Terms, we will issue an appropriate refund.
Digital products
Digital products are delivered electronically. You are responsible for providing a working email address, maintaining access to your device and email account, and using software capable of opening the provided file format. If you do not receive your download or the file does not work, contact jessica@elementalhealthtx.com for assistance.
Personal-use license
Your purchase gives you a limited, revocable, nonexclusive, nontransferable license to download and use the digital product for your own personal, noncommercial use. Copyright and all other ownership rights remain with Life After Divorce and its licensors.
You may not:
Copy, reproduce, upload, publish, distribute, share, sell, sublicense, or give the product or substantial portions of it to another person.
Use the product to create, train, market, or sell a competing product or service.
Remove copyright, trademark, authorship, or proprietary notices.
Post the product in a shared drive, membership, workplace system, course platform, artificial-intelligence system, or public or private online group for use by others.
Use the product for unlawful, infringing, deceptive, or harmful purposes.
Private intensives
Submitting an application or inquiry does not guarantee acceptance or reserve a date. Participation may be declined when the intensive does not appear appropriate for the individual’s needs, when availability is limited, or for another lawful business reason. Accepted participants will receive scheduling and payment instructions. A date is not reserved until any required agreement and payment are completed.
The intensive is a focused educational and coaching-style experience. It is not designed for crisis situations, active safety concerns, diagnosis, treatment of a mental-health condition, custody evaluations, court testimony, or creation of clinical records. Participation does not guarantee a particular personal, relationship, parenting, legal, or financial outcome.
Intensive scheduling and cancellations
Unless different written terms are provided before payment, an intensive may be rescheduled once when written notice is received at least 72 hours before the scheduled start time. Requests received less than 72 hours before the scheduled start time, late arrivals, and missed appointments are not eligible for a refund. If Life After Divorce must cancel and cannot offer a mutually acceptable replacement date, the amount paid for the intensive will be refunded. Any written booking terms presented before payment will control if they differ from this section.
Results and testimonials
Individual experiences differ. We do not guarantee emotional, relationship, parenting, professional, financial, legal, or other results. Testimonials and examples reflect individual experiences and are not promises that another person will obtain the same or similar result.
Website conduct
You agree not to:
Attempt to gain unauthorized access to the website, accounts, systems, or data.
Introduce malicious code, interfere with website operation, or bypass security features.
Scrape, harvest, or use automated means to collect content or personal information without written permission.
Impersonate another person, submit false information, or use the website to harass, threaten, exploit, or violate another person’s rights.
Intellectual property
The website, workbook, text, graphics, branding, downloads, frameworks, exercises, scripts, and other original content are owned by or licensed to Life After Divorce and are protected by applicable intellectual-property laws. No ownership right is transferred to you. Permission to use content beyond the personal-use license must be obtained in writing.
Third-party services and links
The website may rely on or link to third-party services, including payment, scheduling, hosting, email, analytics, and social-media services. We are not responsible for a third party’s independent content, availability, security, terms, or privacy practices.
Disclaimer of warranties
To the fullest extent permitted by law, the website, products, and services are provided “as is” and “as available.” We do not warrant that they will be uninterrupted, error-free, completely secure, or suitable for every person or circumstance. We do not make warranties about specific outcomes. Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.
Limitation of liability
To the fullest extent permitted by law, Life After Divorce, EleMental Health Counseling & Consulting Services, Jessica, and their service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, opportunities, or goodwill arising from use of or inability to use the website, products, or services. To the fullest extent permitted by law, total liability for a claim will not exceed the amount you paid for the product or service giving rise to that claim during the twelve months before the event giving rise to liability. These limitations do not apply where prohibited by law.
Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Before filing a legal claim, you agree to send a written description of the dispute to jessica@elementalhealthtx.com and allow 30 days for an informal attempt to resolve it. Unless applicable law requires otherwise, any court proceeding shall be brought in a state or federal court with jurisdiction in Tarrant County, Texas.
Changes and termination
We may update these Terms by posting a revised version with a new effective date. We may suspend or terminate access when a user violates these Terms, misuses content, threatens safety, or engages in unlawful or fraudulent conduct. Provisions that by their nature should survive termination will remain in effect.
Severability and entire agreement
If a provision is found unenforceable, the remaining provisions will continue to apply. These Terms, together with the Privacy Policy, Disclaimer, Digital Product and Refund Policy, and any written intensive agreement presented before payment, form the agreement governing your use of the applicable offer.
